Passenger dies after falling out of moving vehicle in Plant City

On December 8, 2017, a passenger in a van in Plant City fell out of the moving vehicle into a roadway where he or he was struck by oncoming traffic and died. At the time of publication of this news, there were very few details available regarding how, or why, this happened. Regardless, it brings to light the emotional topic of wrongful death.

If an investigation were to determine the cause of this horrible accident to be failure of a door latch, or an otherwise mechanical failure within the vehicle, the family of the deceased would most definitely have reason to pursue a wrongful death claim. In the alternative, even if it were to be determined that the owner of the van did not make sure a door was properly shut, he or she could also be held liable.

According to Florida statutes, all of the following may be claimed as damages in a wrongful death suit, often resulting in large compensation amounts awarded by the court: Loss of support and services plus interest, loss of companionship, mental anguish, lost parental companionship and guidance, medical expenses, funeral expenses, loss of earnings, mental pain and suffering. Each of these claims is pursuant to the relationship of the claimant to the deceased.

In situations such as the one reported here, an experienced wrongful death attorney can be invaluable in assisting a family with picking up the pieces. Accidents from which these claims arise are usually highly emotional, tragic events that take some time for loved ones to process. At these times, it can be difficult to think clearly and determine how to move forward. An attorney can help a family do just that, while insuring that they can focus on healing while someone else is watching out for their best interests.
