Defective products can mean difference between life or death

Imagine that you are affected with an illness which would require the instant administration of a life-saving drug to stop an adverse reaction. Now, imagine trying to give yourself or your loved one that drug, but the delivery fails. This exact scenario is much more common than one might think, and in fact, has recently been brought to light by several instances of defective Epipens.

Epipens are a pharmaceutical product developed for the instant administration of epinephrine to anyone who may be having a severe, life-threatening allergic reaction. They are disbursed as a ready-to-use instant injection. However, in September, after receiving multiple reports of faulty products, the FDA issued a warning letter to Meridian Medical Technologies, the maker of the Epipen. In that letter, the FDA stated that the manufacturer did not properly inspect its epinephrine injectors, even though it had been made aware of hundreds of complaints by consumers.

According to the FDA, faulty Epipens led to numerous cases where people suffering severe allergic reactions did not get the help they needed. Some of these cases reportedly resulted in death.

The Epipen scandal is only one example in which a defective product can mean the difference between life and death. When we have an injury or illness for which we have no other choice than to rely on these products, we should never have to wonder if the device itself is going to operate correctly. Further, manufacturers of such devices and medications should be held to the highest of standards regarding inspection procedures. Those who have been injured by defective product should be able to recover compensation for their damages through a lawsuit based on the theory of product liability.
