Trucking violations can have devastating consequences

Motorists in Florida know that there are several laws in place to keep people save on the road. We know we should wear our seat belts, obey traffic signals, drive within the speed limit and refrain from drinking and driving, among other things.

However, even when people make all the right decisions behind the wheel and focus on safe driving, they can still get seriously injured in an accident with another driver who was not so cautious. If this other driver is operating an 80,000-pound tractor trailer, the consequences of a collision with a truck will often be catastrophic.

Truckers are expected to comply with the same traffic laws that other motorists must follow in Florida, but they are also required to comply with numerous other regulations and rules that are specific to the trucking industry.

For example, while regular drivers in Florida can talk on a handheld phone while driving, commercial drivers are prohibited from texting and/or using a handheld phone while they are behind the wheel. If a trucker is distracted by a phone, he or she can quickly lose control of the vehicle and cause a devastating crash.

Tired drivers can also be to blame for accidents. Non-commercial drivers are encouraged to avoid driving while fatigued, but there is no law regulating the hours that a regular driver can be driving. Truckers, on the other hand, are expected to record their hours on the road in a log book and take breaks as ordered by the Hours of Service regulations. Truckers who are drowsy can make dangerous mistakes and fall asleep while driving putting them in a position to cause a crash.

There are many other trucking-specific regulations that are in place, but unfortunately most people are unfamiliar with them. If you or a loved one has been injured in an accident with a truck, it can be crucial to discuss the accident with an attorney familiar with state and federal trucking regulations. With legal representation, it may be possible to identify any violations or acts of negligence and take legal action against the appropriate party.
