The aftermath of a slip-and-fall accident

We have all seen them. The funny slip-and-fall videos constantly posted on social media. The ones with captions like, "We all have that clumsy friend," or "How my day is going." In the moment, as a light-hearted display, they can be humorous. However, they have a not so funny side as well. Many times debilitating injuries can occur as a result of that fall. Once the initial shock and embarrassment wear off, these individuals sometimes need significant medical attention for broken bones among other injuries.

Several of those falls captured on video take place in a business. The parties are shown slipping on some substance on the floor, and violently falling while hitting their heads or other body parts on tables, chairs, or shelves around them. This places the responsibility for the fall on a business owner under premises liability.

A business must allow its patrons the security of entering their premises with the reasonable assumption that the premises are safe. One caveat of this rule is that the foreign substance on which a person slipped must have been in place for a length of time. For example, a fast-food restaurant goer cannot spill their own drink on the floor, immediately step in the liquid causing them to slip-and-fall, then blame the restaurant. The substance that caused the fall must have been in place prior to the accident for such a period of time that an employee would have had time to remedy the situation in a normal course of business.
