Florida man files suit after phone explosion

Many Floridians believe they cannot function without their smartphones. Few will consider a smartphone to be dangerous. But recent incidents have placed people in jeopardy and given rise to products liability claims.

Recently a Florida man filed a lawsuit after his smartphone exploded in his pocket. The phone, a Samsung Note7, has been the subject of a product recall due to its propensity to explode. The man claims the phone was in the right pocket of his pants when it exploded. He suffered severe burns to his leg. He is seeking damages in an unspecified amount.

A recall of these phones was initiated by the Consumer Product Safety Commission (CPSC), following numerous reports that a defect with the phone's battery could lead to explosions and fires. Almost one million of these phones were sold in the United States. The recall is only for those sold prior to September 15, 2016. According to the CPSC, almost 97 percent of these phones had the battery that is considered defective.

Those who have purchased a Samsung Note7 that is part of this product recall need to be aware of the potential risks of the product. Those who have been hurt in an explosion or fire involving this phone should be aware of their right to compensation for injury. Under Florida law a negligent manufacturer can be held liable for injuries or deaths caused by an unreasonably dangerous product. A product can be unreasonably dangerous due to a lack of adequate warnings, a design defect or a manufacturing defect.
