Not all truck accident cases should be settled

When a Tampa resident files a civil lawsuit against another party for the recovery of their personal injury damages, there are a number of ways that the case may be resolved. If the injured party takes their claims to court, they may either receive an advantageous verdict and the damages they requested or they may have their claims denied and no awarded damages. They may also choose to settle their case prior to litigation and through their settlement may receive compensation in exchange for releasing the other party from future liability. While for some victims the settlement process may be a good option, it is not always the best course for all victims of personal injury accidents.

When a person suffers injuries due to an accident with a commercial truck, it can be tempting to seek the quickest resolution to the matter and often settlement is a faster means to the end of a legal dispute than litigation. While litigation requires the parties to plead their positions, offer evidence and provide defenses to the other parties' claims, the settlement process can be done face to face as a negotiation with fewer procedural constraints. A victim may receive compensation faster through this method of case resolution, but there is no guarantee that a settlement will yield a victim a higher financial award than one awarded after litigation.

That is one of the risks of settlement. A victim may not fare as well as they would have during litigation and it is often required of victims to release the parties that caused their harm from future claims arising from the relevant accident. Victims who agree to settle their personal injury dispute with trucking companies and truck owners and operators may have to agree to remain silent on the terms of the settlements and may not feel as though the responsible parties were adequately penalized for their injury-causing conduct.

Settlements are just one option for resolving legal disputes. As with all personal injury cases individuals with possible truck accident claims should talk to their own attorneys about whether litigation is a good choice for their legal dilemmas.
