Florida’s Motorcycle Accident Laws and Issues
Motorcycle accident and fatality rates are the highest in the state of Florida out of every state in the United States. On July 1 2000, the State of Florida exempted adult motorcyclist and moped riders from wearing helmets provided they have medical insurance of $10 000.
A 2005 study showed that motorcyclist fatalities increased by 81 percent comparing 2001-2003 to 1997-1999, which is almost double the increase seen nationwide, reported the National Highway Traffic Safety Administration (NHTSA).
Basic Motorcycle Laws Unique to Florida
- Since July 1, 2000, Florida has required riders under the age of 21 to wear helmets while on a motorcycle.
- Those who are 21 and older who choose not to wear helmets while riding a motorcycle must have at least $10,000 in medical insurance coverage.
- In order to operate a motorcycle whose engine is larger than 50 cc, Florida motorcycle drivers must obtain a motorcycle endorsement on their drivers license OR a motorcycle-only license.
- The state of Florida requires motorcycle drivers under the age of 21 to complete a motorcycle safety course before getting a motorcycle endorsement on their license or their motorcycle license. If a driver is 21 or older, he or she has the option of taking a different knowledge and skills test in place of the safety course.
- It is considered a moving violation if, while operating a motorcycle the wheels lose contact with ground, such as doing “wheelies”.
- Motorcycles are not governed by Florida’s No Fault law.
